Baby & Bloom is an online retail store operating at babyandbloom.co.za, selling premium baby and mommy essentials within South Africa. Baby & Bloom is owned and operated as a South African business.

By accessing or using our website, placing an order, or engaging with our content, you confirm that you have read, understood and agree to be bound by these Terms & Conditions.

By using our website you agree to:

• Not use the website to transmit any harmful, offensive or disruptive content

All prices displayed on our website are in South African Rand (ZAR) and are inclusive of VAT where applicable.

We reserve the right to:

• Change prices at any time without prior notice
• Discontinue or modify products without notice
• Limit quantities of any product available for purchase
• Refuse or cancel any order at our discretion

In the event of a pricing error on our website, we reserve the right to cancel any orders placed at the incorrect price. We will notify you immediately and issue a full refund if payment has already been processed.

Product images are for illustrative purposes. While we make every effort to display colours accurately, we cannot guarantee that your device's display will accurately reflect the actual colour of the product.

When you place an order on our website, you are making an offer to purchase the selected products. A binding contract is only formed when we send you an order confirmation email confirming that your order has been accepted and is being processed.

We reserve the right to decline any order for any reason, including but not limited to:

• Product being out of stock
• Suspected fraudulent activity
• Pricing errors
• Inability to process payment

If we are unable to fulfil your order, we will notify you as soon as possible and issue a full refund where payment has been taken.

We accept the following payment methods:

• Visa & Mastercard (credit and debit cards)
• EFT (Electronic Funds Transfer)
• PayFast
• Payflex (buy now pay later)
• Apple Pay & Google Pay (where available)

All payments are processed securely through our payment providers. We do not store your card details. Payment must be received in full before your order is dispatched.

By submitting your payment details, you confirm that you are authorised to use the payment method and that the details provided are correct.

We ship within South Africa only via The Courier Guy. Delivery costs and estimated timeframes are set out in our Shipping & Delivery Policy.

Delivery timeframes are estimates only. Baby & Bloom is not liable for delays caused by the courier, incorrect address details provided by the customer, or circumstances beyond our control.

Risk in the products passes to you upon delivery. Please ensure someone is available to receive your order.

Free shipping is applied automatically on orders over R1,000. This threshold is subject to change at our discretion.

Our full returns and refunds policy is set out in our Returns & Refunds Policy. In summary:

• Returns are accepted within 14 days of delivery
• Items must be unworn, unwashed, with tags attached and in original packaging
• Sale items are not eligible for return unless faulty
• Return shipping costs are at the customer's expense
• Refunds are processed within 3–5 business days of receiving the returned item

Faulty or incorrect items will be replaced or refunded at no cost to you. Please contact us within 48 hours of delivery with photos of the issue.

All content on our website, including but not limited to text, images, logos, graphics, product descriptions and blog posts, is the intellectual property of Baby & Bloom and is protected by South African copyright law.

You may not reproduce, distribute, modify or use any content from our website without our express written permission.

Our logo, brand name and associated trademarks may not be used without prior written consent from Baby & Bloom.

To the fullest extent permitted by South African law, Baby & Bloom shall not be liable for any:

• Indirect, incidental or consequential loss or damage arising from use of our website or products
• Loss of data, profits or business opportunities
• Damage caused by viruses or harmful material that may infect your device through use of our website
• Inaccuracies or errors in product descriptions or pricing (subject to our obligation to correct these)

Our total liability to you in connection with any order shall not exceed the total amount paid by you for that order.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

Your privacy is important to us. How we collect, use and protect your personal information is set out in our Privacy Policy, which forms part of these Terms & Conditions.

By using our website and placing orders, you consent to the collection and use of your personal information as described in our Privacy Policy, in compliance with the Protection of Personal Information Act (POPIA) of South Africa.

Discount codes and promotional offers are subject to the following conditions unless otherwise stated:

• One discount code per order — codes cannot be combined
• Codes are valid for the stated period only and cannot be extended
• Codes apply to full-price items only unless stated otherwise
• Baby & Bloom reserves the right to withdraw or amend any promotion at any time
• Newsletter discount codes are for new subscribers only and single use

These Terms & Conditions are governed by the laws of the Republic of South Africa, including but not limited to:

• The Consumer Protection Act 68 of 2008
• The Electronic Communications and Transactions Act 25 of 2002 (ECT Act)
• The Protection of Personal Information Act 4 of 2013 (POPIA)

Any disputes arising from these terms or your use of our website shall be subject to the exclusive jurisdiction of the South African courts.
